OLD LYME PLANNING COMMISISON
SPECIAL MEETING
TUESDAY, MAY 2, 2017


PRESENT WERE:  Harold Thompson, Steven Ross, Chris Kerr, Edgar Butcher and Barbara Gaudio seated for Robert McCarthy.
ZONING REFERRAL – PETITON TO AMEND SECTION 17 A and 17 B AQUIFER PROTECTION REGULATIONS and ADOPT AN “AQUIFER PROTECTION DISTRICT SURFICIAL AQUIFER PROTECTION AREA.”


Steven Ross made a motion and Barbara Gaudio seconded the motion to disapprove the proposed amendment as written and found it to be inconsistent with the Town Plan of Conservation and Development for the following reasons:

  • The regulation as written will negatively impact much needed commercial development in commercially zoned areas due to over regulation and/or prohibition.
  •  Disagree with the prohibition rather than regulation of businesses which include but are not limited to auto repair.
  • The removal of the definitions of hazardous materials and impervious surfaces. The burden being placed on property owners to establish boundaries of the aquifer district on their site.
In the event the Zoning Commission decides to continue the public hearing we would welcome the opportunity to review a subsequent draft and reconsider our position of disapproval.  The motion passed unanimously.
